Welcome to OnlyUs! These Terms and Conditions ("Terms") govern your use of the OnlyUs mobile application (the "App") and related services provided by OnlyUs ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Eligibility

1.1 Age Requirement

You must be at least 18 years of age to create an account and use OnlyUs. By using the App, you represent and warrant that you are at least 18 years old. We reserve the right to terminate accounts of users who are found to be under 18 years of age.

1.2 Legal Capacity

You must have the legal capacity to enter into a binding agreement to use this App. If you are using the App on behalf of another person, you represent that you have the authority to bind that person to these Terms.

2. Account Registration

2.1 Account Creation

To use OnlyUs, you must create an account using a valid email address, phone number, or Google account. You agree to provide accurate, current, and complete information during registration.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2.3 One Account Per Person

Each user may only create and maintain one account. Creating multiple accounts may result in termination of all associated accounts.

3. Partner Connection

3.1 Connecting with a Partner

OnlyUs is designed for couples. You can connect with one partner at a time using a unique connection code. By connecting with someone, you agree to share certain information with them as described in our Privacy Policy.

3.2 Consent

You must only connect with someone who has consented to use OnlyUs with you. You may not connect with someone without their knowledge or consent.

3.3 Disconnecting

Either partner may disconnect from the relationship at any time through the App. Upon disconnection, shared content access will be removed according to our data policies.

4. Acceptable Use

4.1 Permitted Use

You may use OnlyUs for personal, non-commercial purposes to communicate privately with your partner, share memories, and access our AI assistant features.

4.2 Prohibited Conduct

You agree NOT to:

  • Use the App for any illegal purpose or in violation of any laws
  • Harass, abuse, threaten, or intimidate anyone through the App
  • Share content that is illegal, harmful, abusive, or violates others' rights
  • Distribute malware, viruses, or any harmful code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the App to distribute spam or unsolicited messages
  • Impersonate any person or entity
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems or bots to access the App
  • Share your account credentials with others
  • Use the App if you are under 18 years of age
  • Upload content depicting minors
  • Use the App to facilitate infidelity or deception

5. User Content

5.1 Your Content

You retain ownership of the content you create and share on OnlyUs, including messages, photos, audio messages, and memories ("User Content"). By using the App, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing our services.

5.2 Content Standards

You are solely responsible for your User Content. You agree that your content will not:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Contain illegal content or promote illegal activities
  • Contain malicious code or files

5.3 Content Removal

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice.

6. AI Features (Cloudy)

6.1 Cloudy AI Assistant

OnlyUs includes Cloudy, an AI-powered relationship assistant. Cloudy provides general relationship advice, conversation suggestions, and insights based on information you share.

6.2 Not Professional Advice

Cloudy's responses are generated by artificial intelligence and are for informational and entertainment purposes only. Cloudy does NOT provide:

  • Professional medical advice
  • Mental health therapy or counseling
  • Legal advice
  • Financial advice

If you need professional help, please consult qualified professionals.

6.3 AI Limitations

AI-generated content may not always be accurate, appropriate, or suitable for your specific situation. You use Cloudy at your own discretion and risk.

7. Premium Subscription

7.1 OnlyUs Premium

We offer a premium subscription ("OnlyUs Premium") that provides additional features and higher usage limits. Premium features and pricing are displayed in the App.

7.2 Billing

Premium subscriptions are billed through Google Play Store (Android) or Apple App Store (iOS). By subscribing, you agree to the payment terms of the respective app store.

7.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device's app store settings.

7.4 Refunds

Refund requests are handled by Google Play Store or Apple App Store according to their respective policies. We do not directly process refunds.

7.5 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle.

8. Intellectual Property

8.1 Our Property

The App, including its design, features, code, graphics, logos, and content (excluding User Content), is owned by OnlyUs and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8.2 Trademarks

"OnlyUs," "Cloudy," and associated logos are trademarks of OnlyUs. You may not use our trademarks without prior written consent.

8.3 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use them without compensation or attribution.

9. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our Privacy Policy.

10. Third-Party Services

The App uses third-party services including Google Firebase, RevenueCat, and OpenAI. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

11. Disclaimers

11.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2 No Guarantee

We do not guarantee that:

  • The App will be uninterrupted, error-free, or secure
  • Any defects will be corrected
  • The App will meet your specific requirements
  • AI-generated content will be accurate or appropriate

11.3 Relationship Outcomes

OnlyUs is a communication tool. We make no guarantees about relationship outcomes. The success of your relationship depends on you and your partner, not on our App.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONLYUS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or content
  • Loss of profits or revenue
  • Personal or emotional distress
  • Relationship issues or breakups
  • Unauthorized access to your account
  • Any other damages arising from your use of the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR ₹500 (INR), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless OnlyUs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your User Content
  • Your violation of any rights of others

14. Termination

14.1 By You

You may stop using the App and delete your account at any time. Contact us to request account deletion.

14.2 By Us

We may suspend or terminate your account at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the App ceases immediately.

14.3 Effect of Termination

Upon termination, we may delete your account and associated data. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitation of liability.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at onlyuschat@gmail.com and attempt to resolve the dispute informally for at least 30 days.

15.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

15.3 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in India.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or sending a notification. Your continued use of the App after changes constitutes acceptance of the modified Terms.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OnlyUs regarding the App.

17.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.
